1. TERMS OF USAGE AND USER RESPONSIBILITY
Welcome to PetsyDNA (the “App”, “Service”, “we”, “our”, or “us”).These Terms of Use (“Terms”) govern your access to and use of our mobile application powered by artificial intelligence (AI), which provides features including, but not limited to:
– Dog Breed Scanner (photo/gallery/live camera recognition);
– Food & Toxicity Checker;
– Symptom Checker;
– Feed Amount Calculator;
– Health Risks by Breed;
– Breed Selector.
Please read these Terms carefully before using our Service.
By accessing the App you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any part of the Terms, you must not use the App.
The materials contained in our App are protected by applicable copyright and trademark law.
The App may be used with or without registration, however some features may require an account or active subscription.
2. USE LICENSE
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
You may not:
modify or copy the materials;
use the App for commercial purposes;
reverse engineer or attempt to extract source code;
remove copyright or proprietary notices;
transfer or mirror the App on another server.
All intellectual property (including AI models, algorithms, design, and content) remains the exclusive property of PetsyDNA or its licensors and are protected by applicable laws.
3. DISCLAIMER
The App is intended for informational purposes only.
The App uses artificial intelligence to generate results and recommendations. The materials within our App are provided on an «as is» basis. Our App makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, our App does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to our App.
You acknowledge that:
AI results may not be 100% accurate;
The App does not provide veterinary, medical, or professional advice;
Any decisions regarding your pet’s health, nutrition, or care are made at your own risk.
Always consult a qualified veterinarian when necessary.
4. SUBSCRIPTIONS AND PAYMENTS
4.1 Subscription Model
PetsyDNA offers an auto-renewable subscription:
Price: $12.99 per month
Payment will be charged to your Apple ID account at confirmation of purchase;
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period;
Your account will be charged for renewal within 24 hours prior to the end of the current period;
You can manage and cancel your subscriptions by going to your account settings in the App Store or Google Play.
4.2 Free Features
Some features may be available without subscription, but full functionality requires an active subscription.
4.3 Cancellation
You may cancel your subscription at any time via:
App Store account settings; or
Google Play account settings.
Cancellation will take effect at the end of the current billing cycle. Deleting the App does not cancel your subscription.
4.4 Payments and Refunds
Payments are processed by Apple or Google, not by us.
We do not store payment information.
Refunds are handled exclusively by Apple or Google in accordance with their respective policies, and we do not have control over the refund process.
4.5 Price Changes
We reserve the right to change subscription pricing. Any changes will be communicated in advance and will comply with platform rules.
These Terms constitute the End User License Agreement (EULA) for the App.
5. LINKS
Our App has not reviewed all of the sites linked to its App and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by our App of the site. Use of any such linked website is at the user’s own risk.
6. USER CONTENT AND AI PROCESSING
You retain ownership of all images or content you submit via the App. By uploading content, you grant us a limited, non-exclusive, revocable, worldwide license to use, store, process, and analyze the content for the purposes of providing the core breed recognition functionality, improving the Service, and preventing abuse.
Images submitted may be retained securely for up to 30 days (see our Privacy Policy for full details).
You agree not to upload content that:
Violates any laws or regulations;
Infringes on intellectual property rights;
Contains harmful, obscene, or offensive material;
Is used to abuse or harass others.
We reserve the right to remove content that violates these rules.
7. LIMITATIONS
In no event shall our App or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use our App, even if our App or an authorized representative has been notified orally or in writing of the possibility of such damage.
8. PRIVACY
Your privacy is important to us. Your use of the App is also governed by our Privacy Policy, which forms an integral part of these Terms. Please review our Privacy Policy to understand how we collect, use, and protect your data.
By using the App, you agree to the practices described in the Privacy Policy, including:
Processing of images for AI analysis;
Use of account and device data;
Communication via email or in-app messages for Service-related purposes.
You may opt out of non-essential communications via your profile settings or links in our messages.
9. DISPUTES RESOLUTION
If you have any concern or dispute about the Service, you agree to first try to resolve it informally by contacting us.
10. JURISDICTION-SPECIFIC PROVISIONS
10.1 For users of Ukraine
These Terms constitute a public contract under Article 633 of the Civil Code of Ukraine. The terms are equal for all users.
10.2 For European Union (EU) Users
You benefit from any mandatory provisions of the law of your country of residence.
10.3 United States Federal Government End Use
The Service is a “Commercial Item” as defined in 48 C.F.R. §2.101.
10.4 United States Legal Compliance
You represent that:
you are not located in an embargoed country;
you are not on any U.S. restricted parties list.
10.5 These Terms shall be governed by and construed in accordance with the laws of Ukraine, unless otherwise required by applicable law.
11. CHANGES TO THESE TERMS
We reserve the right to update or modify these Terms at any time. If changes are made, we will update the “Effective Date” and notify you within the App.
Your continued use of the Service after changes constitutes your acceptance of the revised Terms.
